I agree to use the facilities operated by Jack Pine Studio at 21397 State Route 180, Laurelville, OH 43135, or participate in activities sponsored by Jack Pine Studio, upon the express agreement, understanding, and condition that:

 

1) I acknowledge that I participate in (i) activities, including but not limited to, the construction of glass art production equipment and the production of glass art (herein “activities”) that take place at the facilities operated at Jack Pine Studio or (ii) activities sponsored by Jack Pine Studio.

 

2) I represent that I am physically capable of participating in such activities and that to the extent necessary in light of my prior medical history, weight, and general physical condition, I have consulted my personal physician or other medical authority before making such representation.

 

3) I recognize and agree that I am voluntarily participating in these activities and using Jack Pine Studio facilities and that I assume all risks of injury, illness, and other damage or loss inherent or that otherwise might result in my participating in any activities at the Jack Pine Studio facilities or other activities sponsored byJack Pine Studio including but not limited to: burns, cuts, and other similar personal injuries.

 

4) In consideration of the agreement of Jack Pine Studio to sponsor activities and/or provide facilities for my use, I am participating in such activities and using such facilities with the express agreement and understanding that I am waiving, releasing, and discharging Jack Pine Studio and each of its Trustees, officers, employers, agents, and representatives from any and all claims, causes of action, costs, liabilities, expenses (known or unknown) (herein, collectively “claims”) for myself (and my personal representatives, heirs, executors, administrators, agents, and assigns) arising out of my participation in activities at the Jack Pine Studio facilities or at activities sponsored by Jack Pine Studio and any loss, damage, illness, or injury resulting therefrom. I further agree to indemnify and hold harmless Jack Pine Studio and each of its trustees, officers, employees, and representatives from and against all such claims.

 

5) I agree to follow all rules and regulations promulgated by Jack Pine Studio for the use of the Jack Pine Studio facilities or in connection with activities sponsored by Jack Pine Studio. 

 

I acknowledge that I have carefully read this Waiver and Release and fully understand that it is a release of liability. 

 

I acknowledge that I am waiving any right I may have to bring legal action to assert a claim against Jack Pine Studio and Jack Pine Studio Employees for negligence.
